What is in the claim pack
Horizon Parking claims are processed through the Civil National Business Centre in Northampton. The pack contains three documents, and your deadlines come from them.
The N1 Claim Form
Court-sealed, with a claim number, an issue date and the total demanded. The service date on this form starts your 14-day response deadline.
The particulars of claim
The stated basis of the claim. On parking claims these are often a few template sentences, and claims have been struck out where the particulars failed to set out a proper case.
The acknowledgment and defence forms
File the acknowledgment of service within 14 days of service and your defence deadline extends to 28 days from service. These two forms are what prevent a default CCJ.

What Horizon Parking must prove in court
In a defended claim the claimant has to prove every element. Parking claims commonly fail on these four.
A contract formed by the signs
The claim depends on the signs at the site forming a contract with the driver. If the Horizon Parking signage was missing, unlit, poorly placed or unclear, there was no contract to breach.
Keeper liability under POFA 2012
If the driver was never identified, the keeper is only liable when the Horizon Parking Notice to Keeper met the strict deadlines in Schedule 4 of POFA 2012: within 14 days where Horizon Parking ANPR issued the notice. A late notice transfers no liability.
Authority from the landowner
Horizon Parking must hold written authority from the landowner to issue charges and bring claims at that site, and can be required to produce it.
The amount claimed
The £70 fee added to the £100 charge has been refused by county court judges in many defended cases, and interest and costs are challengeable line by line. The defence takes the total apart.

Will I get a CCJ from a Horizon Parking court claim?
Only if you miss the deadlines or lose the case. Respond within 14 days of service and file your defence within 28 days of service, and no CCJ can be entered by default. If a judgment is ever entered and paid within one calendar month, it is removed from the register.
Do Horizon Parking court claims reach a hearing?

No. Parking Mate UK prepares the Court Defence and later court documents but does not provide an advocate to attend the hearing. You can represent yourself and use the prepared Witness Statement, or choose an advocate and provide them with the Court Defence, Witness Statement, evidence and hearing pack.
Is it worth defending a Horizon Parking court claim?
